Liliowa 1A, NIP: 9121927634 (dalej: \u201eOperator&#8221;).<\/p>\n<p>1.2. Aplikacja dost\u0119pna jest w nast\u0119puj\u0105cych wersjach:<\/p>\n<ul>\n<li>\n<p>natywna aplikacja na system iOS (App Store),<\/p>\n<\/li>\n<li>\n<p>natywna aplikacja na system Android (Google Play),<\/p>\n<\/li>\n<li>\n<p>wersja webowa pod adresem <a href=\"https:\/\/app.reklamaindygo.pl\/en\/\" target=\"_blank\" rel=\"noopener\">https:\/\/app.reklamaindygo.pl\/<\/a> \u2013 z ograniczon\u0105 funkcjonalno\u015bci\u0105 w por\u00f3wnaniu do aplikacji natywnych.<\/p>\n<\/li>\n<\/ul>\n<p>Operator zaleca korzystanie z natywnych aplikacji mobilnych (iOS lub Android) w celu uzyskania pe\u0142nej funkcjonalno\u015bci.<\/p>\n<p>1.3. Korzystanie z Aplikacji jest r\u00f3wnoznaczne z akceptacj\u0105 niniejszego regulaminu.<\/p>\n<h5><b>2. Definicje<\/b><\/h5>\n<p>2.1. <b>U\u017cytkownik<\/b> \u2013 osoba fizyczna, prawna lub jednostka organizacyjna nieposiadaj\u0105ca osobowo\u015bci prawnej, korzystaj\u0105ca z Aplikacji.<\/p>\n<p>2.2. <b>Konto<\/b> \u2013 indywidualny profil U\u017cytkownika w Aplikacji, utworzony w wyniku rejestracji.<\/p>\n<p>2.3. <b>Services<\/b> \u2013 funkcje i narz\u0119dzia dost\u0119pne w Aplikacji.<\/p>\n<p>2.4. <b>Asystent AI Sowa Halina<\/b> \u2013 funkcja AI wspieraj\u0105ca U\u017cytkownik\u00f3w.<\/p>\n<p>2.5. <b>Discount codes<\/b> \u2013 specjalne kody udost\u0119pniane przez Operatora <b>w formie graficznej (kody QR) lub tekstowej<\/b>.<\/p>\n<p>2.6. <b>INDYGO card<\/b> \u2013 <b>wirtualna karta sta\u0142ego klienta w formie unikalnego kodu QR, przypisana do Konta U\u017cytkownika.<\/b><\/p>\n<p>2.7. <b>Funkcje Beta<\/b> \u2013 funkcje dost\u0119pne w Aplikacji oznaczone etykiet\u0105 \u201eBeta&#8221;, b\u0119d\u0105ce w fazie test\u00f3w i mog\u0105ce dzia\u0142a\u0107 w spos\u00f3b niepe\u0142ny lub zawiera\u0107 b\u0142\u0119dy.<\/p>\n<p>2.8. <b>Publiczne Testy<\/b> \u2013 program otwartych test\u00f3w przedpremierowych wersji aplikacji iOS i Android, dost\u0119pny dobrowolnie dla U\u017cytkownik\u00f3w.<\/p>\n<h5><b>3. Rejestracja i konto u\u017cytkownika<\/b><\/h5>\n<p>3.1. Aby korzysta\u0107 z pe\u0142nej funkcjonalno\u015bci Aplikacji, U\u017cytkownik musi dokona\u0107 rejestracji, podaj\u0105c prawdziwe dane.<\/p>\n<p>3.2. U\u017cytkownik zobowi\u0105zuje si\u0119 do zachowania poufno\u015bci has\u0142a.<\/p>\n<p>3.3. Operator mo\u017ce zawiesi\u0107 lub usun\u0105\u0107 konto w przypadku naruszenia regulaminu.<\/p>\n<p>3.4. U\u017cytkownik mo\u017ce edytowa\u0107 dane w \u201eMoje konto -&gt; Edytuj profil&#8221; (imi\u0119, has\u0142o, awatar).<\/p>\n<h5><b>4. Korzystanie z aplikacji<\/b><\/h5>\n<p>4.1. U\u017cytkownik zobowi\u0105zuje si\u0119 korzysta\u0107 z Aplikacji zgodnie z prawem i regulaminem.<\/p>\n<p>4.2. Zabronione jest dostarczanie tre\u015bci: bezprawnych, obra\u017aliwych, pornograficznych, nawo\u0142uj\u0105cych do nienawi\u015bci, naruszaj\u0105cych prawa autorskie lub wprowadzaj\u0105cych w b\u0142\u0105d.<\/p>\n<p>4.3. <b>Udost\u0119pnianie plik\u00f3w z innych aplikacji.<\/b> U\u017cytkownicy aplikacji mobilnych (iOS i Android) mog\u0105 udost\u0119pnia\u0107 pliki bezpo\u015brednio do Aplikacji INDYGO z poziomu innych aplikacji (np. z Galerii, Plik\u00f3w, poczty e-mail). Plik udost\u0119pniony w ten spos\u00f3b zostanie automatycznie do\u0142\u0105czony do formularza wysy\u0142ki plik\u00f3w w Aplikacji.<\/p>\n<p>4.4. <b>Karta INDYGO w cyfrowych portfelach.<\/b> U\u017cytkownicy aplikacji mobilnych (iOS i Android) mog\u0105 doda\u0107 swoj\u0105 Kart\u0119 INDYGO do Apple Wallet (iOS) lub Google Wallet (Android), co umo\u017cliwia wygodne pos\u0142ugiwanie si\u0119 kart\u0105 bez konieczno\u015bci otwierania Aplikacji.<\/p>\n<h5><b>5. Kody rabatowe i program lojalno\u015bciowy \u201eZbieraj Sowy&#8221; (Collect Owls)<\/b><\/h5>\n<p>5.1. Operator mo\u017ce udost\u0119pnia\u0107 kody rabatowe. <b>Kody te wyst\u0119puj\u0105 zazwyczaj w formie kod\u00f3w QR, jednak wybrane kody (np. akcje na konkretne produkty o r\u00f3\u017cnych cenach) mog\u0105 przyjmowa\u0107 form\u0119 tekstow\u0105.<\/b><\/p>\n<p>5.2. Kody maj\u0105 okre\u015blony termin i warunki.<\/p>\n<p>5.3. Operator mo\u017ce uniewa\u017cni\u0107 kod przy nadu\u017cyciach.<\/p>\n<p>5.4. Operator prowadzi program lojalno\u015bciowy \u201eZbieraj Sowy&#8221; (Collect Owls), w kt\u00f3rym U\u017cytkownik pos\u0142uguje si\u0119 <b>Kart\u0105 INDYGO<\/b>.<\/p>\n<p>5.5. Za ka\u017cde wydane 100 z\u0142 U\u017cytkownik otrzymuje 1 Sow\u0119.<\/p>\n<p>5.6. Po zebraniu 5 S\u00f3w, w zak\u0142adce \u201eKody rabatowe&#8221; pojawi si\u0119 kod rabatowy o warto\u015bci 50 z\u0142 (wy\u0142\u0105czaj\u0105c ksero, druk, sprzeda\u017c produkt\u00f3w).<\/p>\n<p>5.7. <b>Aby Sowa zosta\u0142a przyznana, U\u017cytkownik musi podczas transakcji udost\u0119pni\u0107 do zeskanowania swoj\u0105 Kart\u0119 INDYGO (kod QR w aplikacji lub w cyfrowym portfelu).<\/b><\/p>\n<p>5.8. <b>Sowy oraz kody rabatowe s\u0105 przyznawane przez system automatycznie. Operator zastrzega, \u017ce ze wzgl\u0119du na specyfik\u0119 rozwi\u0105za\u0144 informatycznych, system mo\u017ce sporadycznie pope\u0142nia\u0107 b\u0142\u0119dy w naliczaniu.<\/b> W przypadku zauwa\u017cenia b\u0142\u0119du U\u017cytkownik proszony jest o kontakt z Operatorem.<\/p>\n<p>5.9. <b>Skorzystanie z kodu rabatowego za 5 S\u00f3w (-50 z\u0142) powoduje zresetowanie licznika S\u00f3w (odj\u0119cie 5 S\u00f3w z konta).<\/b><\/p>\n<h5><b>6. System zam\u00f3wie\u0144<\/b><\/h5>\n<p>6.1. Zam\u00f3wienia sk\u0142adane za po\u015brednictwem strony internetowej oraz aplikacji mobilnych INDYGO trafiaj\u0105 automatycznie do systemu zam\u00f3wie\u0144 Operatora.<\/p>\n<p>6.2. Zam\u00f3wienia z\u0142o\u017cone fizycznie w siedzibie firmy r\u00f3wnie\u017c mog\u0105 by\u0107 wprowadzane do systemu zam\u00f3wie\u0144 \u2013 w takim przypadku U\u017cytkownik zostanie o tym poinformowany przez pracownika Operatora.<\/p>\n<p>6.3. U\u017cytkownik mo\u017ce sprawdzi\u0107 status zam\u00f3wienia w Aplikacji lub na stronie, podaj\u0105c adres e-mail u\u017cyty przy sk\u0142adaniu zam\u00f3wienia, bez konieczno\u015bci posiadania konta w aplikacji.<\/p>\n<p>6.4. Zak\u0142adka \u201eStatus us\u0142ug&#8221; zawiera informacje o dzia\u0142aniu system\u00f3w, stron i funkcji Aplikacji.<\/p>\n<h5><b>7. Powiadomienia push<\/b><\/h5>\n<p>7.1. U\u017cytkownicy aplikacji iOS i Android mog\u0105 w\u0142\u0105czy\u0107 powiadomienia push w ustawieniach Aplikacji lub urz\u0105dzenia.<\/p>\n<p>7.2. Po w\u0142\u0105czeniu powiadomie\u0144 i zalogowaniu na Konto, U\u017cytkownik powi\u0105zany z danym adresem e-mail b\u0119dzie otrzymywa\u0142 powiadomienia o zmianie statusu zam\u00f3wie\u0144 z\u0142o\u017conych na ten adres e-mail.<\/p>\n<p>7.3. Niezale\u017cnie od zam\u00f3wie\u0144, ka\u017cdy U\u017cytkownik z w\u0142\u0105czonymi powiadomieniami push mo\u017ce otrzymywa\u0107 powiadomienia dotycz\u0105ce:<\/p>\n<ul>\n<li>\n<p>zmian i aktualizacji Aplikacji lub strony internetowej,<\/p>\n<\/li>\n<li>\n<p>godzin otwarcia biura INDYGO,<\/p>\n<\/li>\n<li>\n<p>awarii lub przerw w dzia\u0142aniu us\u0142ug,<\/p>\n<\/li>\n<li>\n<p>wa\u017cnych informacji dotycz\u0105cych funkcjonowania firmy,<\/p>\n<\/li>\n<li>\n<p>innych komunikat\u00f3w operacyjnych.<\/p>\n<\/li>\n<\/ul>\n<p>7.4. U\u017cytkownik mo\u017ce w dowolnym momencie wy\u0142\u0105czy\u0107 powiadomienia push w ustawieniach urz\u0105dzenia.<\/p>\n<h5><b>8. Funkcje Beta i Publiczne Testy<\/b><\/h5>\n<p>8.1. W Aplikacji (zar\u00f3wno w wersji webowej, jak i mobilnej) mog\u0105 by\u0107 dost\u0119pne funkcje oznaczone etykiet\u0105 \u201eBeta&#8221;. Funkcje te s\u0105 w fazie test\u00f3w i mog\u0105 dzia\u0142a\u0107 w spos\u00f3b niepe\u0142ny, zawiera\u0107 b\u0142\u0119dy lub by\u0107 niedost\u0119pne bez wcze\u015bniejszego uprzedzenia.<\/p>\n<p>8.2. Korzystanie z funkcji Beta jest dobrowolne. Operator nie ponosi odpowiedzialno\u015bci za ewentualne nieprawid\u0142owo\u015bci wynikaj\u0105ce z korzystania z funkcji oznaczonych jako Beta.<\/p>\n<p>8.3. Operator mo\u017ce udost\u0119pnia\u0107 Publiczne Testy wersji przedpremierowych aplikacji iOS i Android. Udzia\u0142 w testach jest ca\u0142kowicie dobrowolny.<\/p>\n<p>8.4. Wersje testowe mog\u0105 zawiera\u0107 b\u0142\u0119dy, by\u0107 niestabilne lub r\u00f3\u017cni\u0107 si\u0119 od wersji produkcyjnych. Operator nie gwarantuje pe\u0142nej funkcjonalno\u015bci wersji testowych i nie ponosi odpowiedzialno\u015bci za szkody wynik\u0142e z ich u\u017cywania.<\/p>\n<p>8.5. U\u017cytkownik bior\u0105cy udzia\u0142 w testach mo\u017ce zg\u0142asza\u0107 b\u0142\u0119dy i uwagi Operatorowi, co pomo\u017ce w ulepszeniu Aplikacji.<\/p>\n<h5><b>9. Odpowiedzialno\u015b\u0107<\/b><\/h5>\n<p>9.1. Operator nie ponosi odpowiedzialno\u015bci za szkody wynik\u0142e z nieprawid\u0142owego korzystania.<\/p>\n<p>9.2. Operator nie gwarantuje nieprzerwanego dzia\u0142ania.<\/p>\n<p>9.3. Mog\u0105 wyst\u0105pi\u0107 b\u0142\u0119dy j\u0119zykowe, nie wp\u0142ywaj\u0105ce na funkcjonalno\u015b\u0107.<\/p>\n<p>9.4. Asystent AI Sowa Halina nie ma dost\u0119pu do plik\u00f3w, historii zam\u00f3wie\u0144, kont ani formularzy.<\/p>\n<p>9.5. Operator nie odpowiada za skutki polegania na informacji od Asystenta.<\/p>\n<h5><b>10. Dane osobowe<\/b><\/h5>\n<p>10.1. Dane przetwarzane s\u0105 zgodnie z Polityk\u0105 Prywatno\u015bci.<\/p>\n<p>10.2. U\u017cytkownik ma prawo do wgl\u0105du, poprawiania i usuni\u0119cia danych.<\/p>\n<p>10.3. Operator stosuje \u015brodki chroni\u0105ce dane U\u017cytkownik\u00f3w.<\/p>\n<h5><b>11. Postanowienia ko\u0144cowe<\/b><\/h5>\n<p>11.1. Operator zastrzega sobie prawo do wprowadzania zmian w regulaminie. O istotnych zmianach U\u017cytkownicy b\u0119d\u0105 informowani tak\u017ce e-mailem oraz poprzez Aplikacj\u0119.<\/p>\n<p>11.2. Dalsze korzystanie z Aplikacji oznacza akceptacj\u0119 zmian.<\/p>\n<p>11.3. W przypadku braku akceptacji U\u017cytkownik mo\u017ce usun\u0105\u0107 konto.<\/p>\n<p>11.4. Sprawy nieuregulowane podlegaj\u0105 prawu polskiemu.<\/p>\n<p>11.5. These Terms define the rules for using the INDYGO application (the &#8220;App&#8221;), owned by INDYGO Tomasz Pajdak, ul. Liliowa 1A, Jelcz-Laskowice, NIP: 9121927634 (the &#8220;Operator&#8221;).<\/p>\n<p>1.2. The App is available in the following versions:<\/p>\n<ul>\n<li>\n<p>native iOS app (App Store),<\/p>\n<\/li>\n<li>\n<p>native Android app (Google Play),<\/p>\n<\/li>\n<li>\n<p>web version at <a href=\"https:\/\/app.reklamaindygo.pl\/en\/\" target=\"_blank\" rel=\"noopener\">https:\/\/app.reklamaindygo.pl\/<\/a> \u2013 with limited functionality compared to the native apps.<\/p>\n<\/li>\n<\/ul>\n<p>The Operator recommends using the native mobile apps (iOS or Android) for full functionality.<\/p>\n<p>1.3. Using the App constitutes acceptance of these Terms.<\/p>\n<h5><b>2. Definitions<\/b><\/h5>\n<p>2.1. <b>User<\/b> \u2013 a natural person, legal entity, or organizational unit using the App.<\/p>\n<p>2.2. <b>Account<\/b> \u2013 individual profile created via registration.<\/p>\n<p>2.3. <b>Services<\/b> \u2013 features and tools available in the App.<\/p>\n<p>2.4. <b>AI Assistant Sowa Halina<\/b> \u2013 AI feature supporting Users.<\/p>\n<p>2.5. <b>Discount codes<\/b> \u2013 special codes provided by the Operator <b>in graphical form (QR codes) or text form<\/b>.<\/p>\n<p>2.6. <b>INDYGO Card<\/b> \u2013 <b>a virtual loyalty card in the form of a unique QR code assigned to the User&#8217;s Account.<\/b><\/p>\n<p>2.7. <b>Beta Features<\/b> \u2013 features available in the App marked with a &#8220;Beta&#8221; label, currently in testing and potentially incomplete or containing errors.<\/p>\n<p>2.8. <b>Public Testing<\/b> \u2013 an open pre-release testing program for iOS and Android app versions, available voluntarily to Users.<\/p>\n<h5><b>3. Registration and User Account<\/b><\/h5>\n<p>3.1. Full App functionality requires registration with truthful data.<\/p>\n<p>3.2. Users must keep passwords confidential.<\/p>\n<p>3.3. The Operator may suspend or delete accounts for Terms violations.<\/p>\n<p>3.4. Users may edit profile data in &#8220;My Account -&gt; Edit Profile&#8221; (name, password, avatar).<\/p>\n<h5><b>4. Use of the App<\/b><\/h5>\n<p>4.1. Users must use the App in compliance with law and these Terms.<\/p>\n<p>4.2. Users may not provide content that is unlawful, offensive, pornographic, incites hatred, infringes copyrights, or is misleading.<\/p>\n<p>4.3. <b>Sharing files from other apps.<\/b> Users of the mobile apps (iOS and Android) can share files directly to the INDYGO App from other apps (e.g., Gallery, Files, email). A file shared this way will be automatically added to the file submission form within the App.<\/p>\n<p>4.4. <b>INDYGO Card in digital wallets.<\/b> Mobile app users (iOS and Android) can add their INDYGO Card to Apple Wallet (iOS) or Google Wallet (Android), enabling convenient use of the card without opening the App.<\/p>\n<h5><b>5. Discount Codes and Loyalty Program &#8220;Zbieraj Sowy&#8221; (Collect Owls)<\/b><\/h5>\n<p>5.1. Operator may provide discount codes. <b>These codes are primarily in QR code format, but some codes (e.g., promotions for specific products with varying prices) may be in text format.<\/b><\/p>\n<p>5.2. Codes have specified validity and terms.<\/p>\n<p>5.3. Operator may cancel codes in case of abuse.<\/p>\n<p>5.4. Operator runs loyalty program &#8220;Zbieraj Sowy&#8221; (Collect Owls) using the <b>INDYGO Card<\/b>.<\/p>\n<p>5.5. 1 Owl is awarded per PLN 100 spent.<\/p>\n<p>5.6. After collecting 5 Owls, a PLN 50 discount code appears in &#8220;Discount Codes&#8221; (excluding photocopying, printing, product sales).<\/p>\n<p>5.7. <b>To receive an Owl, the User must scan their INDYGO Card (QR code in the App or digital wallet) during the transaction.<\/b><\/p>\n<p>5.8. <b>Owls and discount codes are awarded automatically by the system. The Operator reserves that, due to the nature of IT systems, errors in calculation may occasionally occur.<\/b> In such cases, please contact the Operator.<\/p>\n<p>5.9. <b>Using the 5-Owl discount code (-50 PLN) resets the Owl count (deducts 5 Owls).<\/b><\/p>\n<h5><b>6. Order System<\/b><\/h5>\n<p>6.1. Orders placed through the INDYGO website and mobile apps are automatically submitted to the Operator&#8217;s order management system.<\/p>\n<p>6.2. Orders placed in person at the company&#8217;s premises may also be entered into the order system \u2013 in such cases, the User will be informed by a staff member.<\/p>\n<p>6.3. Users can check order status in the App or on the website by providing the email address used when placing the order, without needing an account.<\/p>\n<p>6.4. &#8220;Service Status&#8221; shows the operational status of systems, websites, and App features.<\/p>\n<h5><b>7. Push Notifications<\/b><\/h5>\n<p>7.1. Users of the iOS and Android apps may enable push notifications in the App or device settings.<\/p>\n<p>7.2. Once notifications are enabled and the User is logged in, they will receive push notifications about order status changes for orders placed using their account&#8217;s email address.<\/p>\n<p>7.3. Regardless of orders, all Users with push notifications enabled may receive notifications regarding:<\/p>\n<ul>\n<li>\n<p>App or website changes and updates,<\/p>\n<\/li>\n<li>\n<p>INDYGO office hours,<\/p>\n<\/li>\n<li>\n<p>service outages or interruptions,<\/p>\n<\/li>\n<li>\n<p>important company operational information,<\/p>\n<\/li>\n<li>\n<p>other operational communications.<\/p>\n<\/li>\n<\/ul>\n<p>7.4. Users may disable push notifications at any time in their device settings.<\/p>\n<h5><b>8. Beta Features and Public Testing<\/b><\/h5>\n<p>8.1. Features marked with a &#8220;Beta&#8221; label may be available in the App (both web and mobile versions). These features are in testing and may be incomplete, contain errors, or become unavailable without prior notice.<\/p>\n<p>8.2. Use of Beta features is voluntary. The Operator is not liable for any issues arising from the use of features labeled Beta.<\/p>\n<p>8.3. The Operator may offer Public Testing of pre-release iOS and Android app versions. Participation is entirely voluntary.<\/p>\n<p>8.4. Test versions may contain bugs, be unstable, or differ from production versions. The Operator does not guarantee full functionality of test versions and is not liable for damages resulting from their use.<\/p>\n<p>8.5. Users participating in testing may report bugs and feedback to the Operator to help improve the App.<\/p>\n<h5><b>9. Liability<\/b><\/h5>\n<p>9.1. Operator is not liable for improper use.<\/p>\n<p>9.2. No guarantee of uninterrupted operation.<\/p>\n<p>9.3. Language errors may occur without affecting functionality.<\/p>\n<p>9.4. AI Assistant Sowa Halina has no access to files, order history, accounts, or forms.<\/p>\n<p>9.5. Operator is not liable for decisions made based on the Assistant&#8217;s information.<\/p>\n<h5><b>10. Personal Data<\/b><\/h5>\n<p>10.1. Data is processed according to the Privacy Policy.<\/p>\n<p>10.2. Users may access, correct, or delete data.<\/p>\n<p>10.3. Operator applies appropriate protection measures.<\/p>\n<h5><b>11. Final Provisions<\/b><\/h5>\n<p>11.1. Operator may update the Terms. Users will be informed of significant changes by e-mail and via the App.<\/p>\n<p>11.2. Continuing use indicates acceptance.<\/p>\n<p>11.3. Users who disagree may delete their accounts.<\/p>\n<p>11.4. Matters not covered are subject to Polish law.<\/p>\n<p>11.5.
